1. Introduction

Welcome to Fifth June. These Terms and Conditions ("Terms") govern your use of our waste management and recycling services, including Raddi (scrap pickup service) and eRecycle (e waste recycling plant), operated by Fifth June ("Company," "we," "us," or "our").

By accessing our website at fifthjune.in or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our services.

These Terms constitute a legal agreement between you (the "User" or "Customer") and Fifth June, governed by the laws of India.

2. Services Offered

2.1 Raddi (Scrap Pickup Service)

Raddi provides doorstep collection of dry recyclable solid waste including paper, cardboard, plastic, metal, glass, and electronic items. We facilitate the sale of your scrap materials to authorized recyclers and provide instant payment via UPI.

2.2 eRecycle (E Waste Recycling Plant)

eRecycle is our government certified e waste recycling facility that provides secure data destruction, IT asset disposal, and compliant electronics recycling services for businesses and institutions. We operate in accordance with the E Waste Management Rules, 2016.

2.3 Service Area

Our services are currently available in Mumbai, Maharashtra, India. Service areas may be expanded or modified at our discretion.

3. User Registration and Account

To use our services, you may be required to create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that the information you provide is accurate and up to date

You must be at least 18 years of age to use our services. By using our services, you represent that you have the legal capacity to enter into this agreement.

4. Booking and Scheduling

For Raddi services, you may schedule pickups through our website or other designated channels. By booking a pickup, you agree that:

• You will make the scrap materials available at the scheduled time and location
• The materials are properly segregated and accessible
• You have the legal right to dispose of the materials
• The materials do not contain hazardous, illegal, or prohibited substances

We reserve the right to cancel or reschedule pickups due to unforeseen circumstances, weather conditions, or operational requirements. You will be notified of any such changes.

5. Pricing and Payment

5.1 Pricing

Scrap rates are determined based on market conditions and material type. Current rates are available on our website and may be updated periodically. Final payment is calculated based on the actual weight and quality of materials collected.

5.2 Payment Terms

For Raddi services, payment is made instantly via UPI upon completion of pickup and weighing. For eRecycle corporate services, payment terms will be as agreed in the service contract.

5.3 Taxes

All prices are inclusive of applicable taxes including GST as per Indian tax laws. Tax invoices will be provided as required by law.

6. Material Acceptance and Rejection

We reserve the right to reject any materials that:

• Are hazardous, toxic, or pose health and safety risks
• Are prohibited under applicable laws and regulations
• Are contaminated with wet waste, food waste, or other non recyclable materials
• Are not properly segregated or prepared for collection
• Cannot be legally recycled or disposed of

Our collection partners have the authority to refuse collection of such materials at the pickup location.

7. Data Security and Destruction

For eRecycle services involving electronic devices with data storage:

• We provide secure data destruction services in compliance with industry standards
• Certificates of data destruction can be provided upon request
• Customers are responsible for backing up any data they wish to retain before disposal
• We are not liable for any data loss or recovery after devices are handed over to us

We recommend that customers perform their own data wiping before handing over devices for recycling.

8. Environmental Compliance

Fifth June is committed to environmental sustainability and operates in compliance with:

• E Waste Management Rules, 2016
• Solid Waste Management Rules, 2016
• Plastic Waste Management Rules, 2016
• All applicable environmental laws and regulations in India

We ensure that all collected materials are sent to authorized recyclers and processed in an environmentally responsible manner.

9. Liability and Indemnification

9.1 Limitation of Liability

To the maximum extent permitted by law, Fifth June shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from delays, cancellations, or service interruptions
• Damage to property caused by third party collection partners, except where such damage is due to gross negligence

9.2 User Indemnification

You agree to indemnify and hold harmless Fifth June and its partners from any claims, damages, or expenses arising from your violation of these Terms, applicable laws, or third party rights.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Fifth June or its licensors and is protected by Indian and international copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

11. Cancellation and Termination

11.1 Cancellation by User

You may cancel a scheduled pickup by notifying us at least 2 hours before the scheduled time. Late cancellations may result in cancellation fees.

11.2 Termination by Company

We reserve the right to suspend or terminate your access to our services if you violate these Terms, engage in fraudulent activities, or misuse our services.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

We encourage users to contact us first to resolve any disputes amicably before pursuing legal action.

13. Consumer Rights

As per the Consumer Protection Act, 2019, you have the right to:

• Fair and transparent service delivery
• Protection against unfair trade practices
• Seek redressal for service deficiencies
• File complaints with consumer forums if your grievances are not resolved

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
